The Social Residential Homes Act (SRHA):

(a) Replaces existing legislation, including the Homes for the Aged Act and relevant provisions in the Children and Young Persons Act and Destitute Persons Act.

(b) Establishes a common regulatory framework for various types of Social Residential Homes.

(c) Codifies and harmonises care standards across different Social Residential Homes to ensure consistent quality of care.

The SRHA introduces three key features to enhance care quality and regulation in Social Residential Homes:

1. Stronger safeguards for residents' safety and well-being, including consistent care standards, improved safety measures, and provisions for continuity of care;

2. A more comprehensive enforcement framework with enhanced investigative powers and revised penalty quanta for non-compliance; and

3. An appeal mechanism for operators to seek review of regulatory decisions, ensuring fairness and transparency in the implementation of the new licensing framework.
