Commissioner for the Maintenance of Parents (CMP) Process Overview
1. Application at the Commissioner's Office
Parent files an application for maintenance and attends an intake interview at the Commissioner's Office.
2. Conciliation
Parent and child attends conciliation (separate/joint) to help them resolve maintenance issues out-of-court. If there is an agreement at conciliation, a Memorandum of Agreement may be signed.
Tribunal for the Maintenance of Parents (TMP) Process Overview
1. Application at Tribunal
If conciliation is unsuccessful, parent may file an application with the Tribunal.
2. Mediation
Parent and children will be referred for mediation. If there is a settlement at mediation, a Memorandum of Agreement may be signed and made into a maintenance order by the Tribunal.
3. Tribunal Hearing
If the parent and children are unable to reach a settlement after mediation, they will be scheduled to appear before a Tribunal hearing. Both parent and children must be present at the hearing.
